Senegal adopts a law on digital and ethical advertising 📣

The advertising sector in Senegal is entering a new era thanks to a reform adopted on January 4, 2025. This legislation aims to modernize an industry long marked by outdated practices, while addressing challenges posed by the rise of new technologies.

A specific regulation 🌍

Digital platforms dominate the media landscape. Aware of this evolution, Senegalese lawmakers have prioritized the regulation of online advertisements. Among the measures is the introduction of transparency in the use of personal data.

Advertisers operating on digital platforms are now required to inform users about the data collected, its usage, and to guarantee its confidentiality. This approach is designed to build trust among internet users, who remain wary of intrusive practices.
At the same time, penalties will be applied in cases of non-compliance, thereby reinforcing the effectiveness of the legislative framework.

Boosting local innovation 🏢

Beyond the constraints imposed on businesses, this reform also opens up opportunities. The Senegalese government aims to actively support local players in the advertising sector by offering incentives to encourage the adoption of modern technologies and innovative practices. Additionally, it seeks to create an environment conducive to the growth of startups and local SMEs.

Moreover, the new law highlights an often-overlooked issue: social and cultural representation in advertising campaigns. Lingering questions 🤔

However, no reform, no matter how ambitious, can avoid challenges in its implementation. To begin with, the advertising market in Senegal remains fragmented, making it difficult to standardize practices. Certain geographic areas or categories of advertisers might escape regulatory oversight, which could weaken the law’s impact.

In addition, the lack of robust and fully operational regulatory structures presents a significant limitation. Without effective mechanisms for monitoring and enforcement, the rules risk becoming mere formalities. Finally, the costs associated with compliance might discourage some small businesses from aligning with the new standards.
